Moving Abroad After Divorce: Fresh Start or Running Away?
The divorce papers are signed. The house feels too quiet. And one question keeps coming back at night: what if I just left?
You are not alone in asking it. Divorce is common across the developed world. In 2022, crude divorce rates ranged from 0.6 divorces per 1,000 people in Colombia to 3.6 per 1,000 in Chile. Six OECD countries, including Belgium, Korea and Portugal, have seen their divorce rates more than double since 1970 (OECD Family Database, SF3.1, 2025).
The short answer: Yes, you can move abroad after a divorce, and for many people it works. But the order matters. First, make the divorce final and get a court-approved financial order, including any pension split. Second, if you have children, get written consent from the other parent or a court order. Moving a child without it can be child abduction. Third, check whether your visa depended on your ex. Many spouse and dependant visas end when the relationship ends. Only then choose a country and a route that works for one person: a skilled job, a job seeker visa or a digital nomad visa.
Rules and numbers at a glance
These are the key legal and visa facts most divorced movers hit. Rules change, so confirm each one before you act. Figures are as of October 2026.
| Rule | Figure or requirement | Source |
|---|---|---|
| England and Wales divorce application fee | £628 | GOV.UK, 2026 |
| Wait before you can apply for a conditional order | 20 weeks after the application is issued | GOV.UK, 2026 |
| Wait before you can apply for a final order | At least 43 days (6 weeks and 1 day) after the conditional order | GOV.UK, 2026 |
| Consent order (agreed money split) court fee | £62, only after the conditional order | GOV.UK, 2026 |
| UK visas based on a relationship | You must usually tell the Home Office when you separate | GOV.UK, 2026 |
| Non-EU spouse of an EU citizen keeps residence | Marriage lasted 3+ years before divorce started, with 1+ year in the host country (or custody/access rights) | Your Europe, 2026 |
| US conditional green card after divorce | You can ask USCIS to waive the joint filing if you married in good faith | USCIS, 2026 |
| Canada: sponsor's duty to support an ex-spouse | 3 years from the date they became a permanent resident, even after divorce | IRCC, 2026 |
| US Social Security on an ex-spouse's record | Possible if the marriage lasted at least 10 years | SSA, 2026 |
| Hague Child Abduction Convention | 103 Contracting Parties | HCCH, 2026 |
The UK figures are examples. Rules differ by country, and in the US by state. The principle does not: finish the legal work before you rebuild elsewhere.
Fresh start or running away?
This is the question nobody else can answer for you. So be honest with yourself.
A move can be a real fresh start. A new place gives you new routines. Nobody knows your old story. You get to choose who you are again. Staying can mean seeing the ex's car and the friends who took sides. Distance can bring calm.
But a move can also be a way to avoid grief. The sadness, anger and loneliness come with you. If you move to escape feelings, you may face them in a new country, with no friends nearby to help.
Ask yourself these questions, and write the answers down:
- Would I still want this country if I had never divorced?
- Am I moving towards something, or only away from something?
- Who will I call on a bad night in month three?
- Can I afford to come back if it does not work?
- If I have children, what will this move cost them?
No single answer is wrong. But a pattern will appear. If most answers are about the past, give yourself more time. If most are about the future, you may be ready to plan.
One practical test: try a long visit first. Rent a flat for a few weeks, outside the tourist season. Shop, cook and get lost. A holiday shows you the best of a place. A month of normal life shows you the truth.

Free eligibility check →Step 1: Make the divorce and money final first
Leaving before the legal work is done is a costly mistake. Courts and banks are harder to deal with from abroad.
In England and Wales, the process has two waiting periods. You must wait 20 weeks after your application is issued before you can apply for a conditional order (GOV.UK, 2026). Then you must wait at least 43 days before you can apply for the final order (GOV.UK, 2026). So the minimum is a little over six months.
The money split is a separate step. Getting divorced does not end your financial ties to your ex. GOV.UK says that if you want a legally binding arrangement for dividing money and property, "you must apply to the court for this before you apply for a final order" (GOV.UK, 2026).
If you both agree, you apply for a consent order. The court fee is £62. You can only apply after the conditional order. If you wait until after the final order, "there may be financial consequences, particularly for pensions" (GOV.UK, 2026).
Why does this matter for a move? Because an agreement on paper is not the same as a court order. Without the order, your ex may be able to make a claim later. That claim could reach money you earn or save in your new country.
Step 2: Split pensions the right way
Pensions can be one of the largest assets in a marriage. They are also easy to forget.
- UK: A consent order can cover how you divide pensions, property, savings and investments (GOV.UK, 2026).
- US workplace plans: A retirement plan only pays an ex-spouse under a "qualified domestic relations order" (QDRO). It can assign some or all of a participant's benefits to "a spouse, former spouse, child, or other dependent" (US Department of Labor, 2026). A signed agreement alone is not enough. A court or state agency must issue or approve it.
- US Social Security: Ex-spouses who were married for at least 10 years may be eligible for benefits on the other person's record (SSA, 2026). If your marriage was close to 10 years, ask a lawyer before you finalise the date.
Once the split is done, check how your pension will be paid and taxed abroad. Our guide to pension and Social Security portability covers which payments follow you across borders.
Step 3: Children come first, and consent is not optional
If you have children, this step decides everything else.
In the UK, "you must get the permission of everyone with parental responsibility for a child or from a court before taking the child abroad". GOV.UK is clear: "Taking a child abroad without permission is child abduction" (GOV.UK, 2026). Similar rules apply in many other countries.
The 1980 Hague Child Abduction Convention has 103 Contracting Parties (HCCH, 2026). Between those countries, a child taken without consent is usually sent back. Being the main carer does not, on its own, change that.
So never plan a move with your children unless the other parent agrees in writing or a court allows it. If the other parent says no, the answer is a court application, not leaving anyway. A court will look at what is best for your child, not what is best for you.
Ask yourself: how will my child keep a real relationship with their other parent? Who pays for the flights? What happens at school holidays?

Step 4: Check what divorce does to your visa
If you live abroad already on a spouse or dependant visa, the divorce may end your right to stay.
| Country or area | What happens after separation or divorce | Source |
|---|---|---|
| United Kingdom | You must usually tell the Home Office. You will have to apply to stay on another basis or leave. Help exists if you face domestic abuse. | GOV.UK, 2026 |
| European Union | A non-EU spouse of an EU citizen can keep residence if the marriage lasted at least 3 years before proceedings started, including 1 year in the host country, or with custody or court-ordered access to a child there | Your Europe, 2026 |
| United States | A conditional green card applies if you married less than 2 years before getting residence. After a good-faith marriage ends in divorce, you can ask to waive the joint filing on Form I-751. | USCIS, 2026 |
| Canada | Conditional permanent residence for sponsored spouses ended on 28 April 2017. Once you are a permanent resident, you keep it. | IRCC, 2017 |
In the UK, the same duty applies if you are a dependant on your partner's UK visa, such as a work visa (GOV.UK, 2026). Other countries vary, so check early. Did you sponsor your ex to Canada? Then you stay financially responsible for them for 3 years after they became a permanent resident, even after divorce (IRCC, 2026).
For how partner and dependant visas work in each country, see our spouse and family visa guide.
Step 5: Choose a country and a route for one person
For years, you planned for two. Now every budget is for one income. That can feel scary. It can also feel free.
Start with three questions. What can I earn? What can I afford alone? Where will I find people?
Then match yourself to a route:
| Route type | Example | Key requirement (as of October 2026) | Source |
|---|---|---|---|
| Skilled worker with a job offer | UK Skilled Worker visa | Usually £41,700 a year or the job's going rate, whichever is higher | GOV.UK, 2026 |
| Job seeker | Germany Opportunity Card | Recognised qualification, or a qualification plus 6 points; €1,091 a month in a blocked account; up to 1 year; part-time work up to 20 hours a week | Make it in Germany, 2026 |
| Digital nomad / remote work | Portugal D8 | Average income of 4 times the minimum wage over the last 3 months; with a 2026 minimum wage of €920, that is €3,680 a month | Portuguese Embassy; MNE, 2026 |
Have a strong trade or degree but no offer? Read our Germany Opportunity Card guide. Is your job in short supply? Check countries with labour shortages. Can you keep a remote job? Compare the best digital nomad visas for 2026. Over 55? Try the retirement visa finder.
Then do the money test. Use the cost of living tool with one income, not two. Add fees from the visa cost calculator. Keep a return fund, so you can come home without panic if it fails.
Common mistakes
- Leaving before the final order. Court hearings, signatures and bank checks become slow and costly from abroad.
- Relying on an informal money agreement. Without a court order, your ex may be able to make a claim later.
- Forgetting the pension. It may be your biggest asset. Split it in the order, not after.
- Moving children without consent. It can be child abduction, and the child will usually be returned.
- Budgeting for two incomes. Your old plans assumed a partner's salary. Redo every number for one.
- Choosing a country for its distance from your ex. Choose it for work, cost, safety and people.
When to get a licensed lawyer or adviser
Get a family lawyer in the country where you divorce if:
- you have children and the other parent does not agree to the move;
- your ex has a pension, business or property abroad;
- you are not sure the financial order covers everything;
- there has been domestic abuse.
Get a licensed immigration adviser if your visa depends on your ex. Get a cross-border tax adviser before you move a pension or sell a home. Check any adviser on the official register before you pay.
If you want a clear plan for your own situation, our migration assessment matches your skills, budget and goals to real routes.
The emotional side: rebuilding alone
Many people who move after a divorce feel two things at once. Relief, because the fight is over. And fear, because nobody is beside them.
Both are normal. Plan for the hard days. Join one group in your first month, such as a language class or a sports club. Keep one weekly call with someone who knew you before. Set a review date twelve months in, and ask: am I building a life here, or hiding here?
Your new life does not need to prove anything to your ex. It only needs to work for you.
Frequently asked questions
Can I move abroad before my divorce is final?
You can, but it is risky. Court steps and money talks are harder from another country. In England and Wales, a financial order should be applied for before the final order, so finish both first.
Can I take my children abroad after a divorce?
Only with the consent of everyone with parental responsibility or a court's permission. In the UK, doing it without permission is child abduction. Between the 103 Hague Convention parties, children taken without consent are usually returned.
Will my spouse visa end if I get divorced?
Often, yes. In the UK, you must usually tell the Home Office and then apply to stay on another basis or leave. In the EU, a non-EU spouse may keep residence after a long enough marriage or with custody rights. In the US, a conditional resident can ask to waive the joint filing after a good-faith marriage ends.
What happens to my pension if I move abroad after divorce?
Your pension split should be decided in the financial order before you leave. In the US, workplace plans pay an ex-spouse only under a qualified domestic relations order. After the split, check how each pension is paid and taxed in your new country.
Which visa is best for someone moving alone after divorce?
It depends on your skills and money. A skilled worker visa needs a job offer. A job seeker visa, such as Germany's Opportunity Card, suits a recognised trade or degree. A digital nomad visa suits a remote job.
Is moving abroad after divorce running away?
Not always. It is a fresh start if you are moving towards a life you want. It can be running away if the main reason is to escape pain you have not faced. Asking yourself honest questions, and waiting a few months, helps you tell the difference.
A new map, drawn by you
A divorce ends one plan. It does not end your right to make a new one. Finish the legal work. Protect your children's bond with both parents. Check your visa and your pension. Then pick a place for what it offers you, not for how far it is from the past.
You get to draw this map yourself. Take your time with it.
